 State to pay for 'Nord-Ost' using money stolen by investigators from dead hostages
On Thursday the Zamoskvoretsky court in Moscow ruled to satisfy claims by victims of the 2002 terrorist attack on Dubrovka. For many years the 'Nor'easters' have been demanding the return of money taken by members of the investigative team from the Moscow prosecutor's office — money, which disappeared during the preliminary investigation.
Judge Larisa Kashtanova decided to award from the state budget 9,845 rubles (ed: about $400) to the family of Maksim Mikhailov, the CEO of the Kaliningrad radio station 'Baltic Wave' who was slain during the hostage rescue operation, and 82,720 rubles (ed: about $3,300) to former hostage Yekaterina Dolgaya, a resident of the Chelyabinsk region. They were also compensated in full for attorney's fees and court costs. The Finance Ministry is to pay the victims a total of about 128 thousand rubles (ed: about $5000).
The scandalous fact, that officers from the prosecutor's office robbed dead hostages, came to light from materials in the 'Nord-Ost' case. In 2005 and 2006, the family of deceased hostage Maksim Mikhailov, and surviving hostage Yekaterina Dolgaya, filed with the Moscow city prosecutor a demand for the initiation of a criminal case of looting. In 2005, Vladimir Kalchuk, head of the investigative group, accused Senior Investigator Denis Lelyukhin of the theft. Denis Lelyukhin by this time had been killed in a car accident. Lelyukhin's father, in order to clear his son's name, intervened and wrote a complaint to the FSB. Deputy Moscow Public Prosecutor Sergey Lapin acknowledged that accusations against Denis Lelyukhin were unfounded, but refused to initiate a criminal case of looting on behalf of the 'Nor'easters' because of the «lack of evidence of a crime.»
Igor Trunov and Lyudmila Ayvar, lawyers for the victims, continue to seek a judicial precedent. «There has been no man-made disaster or terrorist attack where there has not been looting by law enforcement agencies,» said Igor Trunov, who has spent much time studying this unfortunate phenomenon. «The plane crash in Perm, the collapse of Transvaal Park in Moscow, and even in the Frenkel case — when his apartment was searched and 200 thousand rubles were seized and disappeared without trace.»
If, with difficulty, the Moscow prosecutor's office acknowledges theft of money from victims, then nothing is clear concerning money seized from terrorists. «Case records contain information that large sums of money, in dollars and rubles, were found on the militants who seized the theatrical center,» Igor Trunov recounted to 'Novaya Gazeta'. «By law, this money should have been put into special bank accounts to record funds seized during the investigation, but we have serious doubts that the money was credited to these accounts in full.»
Despite the legal precedent, lawyers for the 'Nord-Ost' victims are not entirely pleased with the outcome, and intend to appeal the decision of the Zamoskvoretsky court. They are outraged that the court denied compensation for non-pecuniary damages and lost interest. «This money could have been put in the bank and collected interest all these years,» said Lyudmila Ayvar.
According to the lawyer: «We already have 17 similar lawsuits from other 'Nor’easters'. In the future, such lawsuits will be much larger, and not just on this case.»

Просто в удивительном государстве мы живем! Суд признал факт мародерства- кражи денег из кошелька погибшего заложника уже на этапе следствия,т.е не в зале ДК. (Речь идет о трех тысячах рублей и около двухсот долларов…)А теперь следователи требуют не только подтвердить законность этих денег (не ворованные ли), т.е необходимо через 7 лет доказать, где и как ты их приобрел, но и характеристику с места работы человека, который погиб 6 лет назад! Т.е., если ты- честно и хорошо работаешь, то может и вернем, а, если ты пьяница и гулена, то деньги из твоего кошелька изымаются в пользу государства???? Может еще посмотрим, есть ли грамоты у тебя в копилке, был ли ты пионером, переводишь ли старушек через улицу, ставишь ли ребенка в угол… Господа, вы не «заигралась» во власть?! Чего проще вернуть похищенное и извиниться за нечистых на руку коллег, и все, тема закрыта! Нет, надо судиться, требуя все новые и новые бумажки…Потрясающее у нас правосудие!!!

Алена, я не поняла почему «удивительное государство», чему можно еще удивляться после "Норд-Оста «, Беслана,Курска». " Газ безвредный и не один человек не пострадал от газа "- после этого можно удивляться? «Чем чудовищнее ложь — тем скорее в нее поверят» -известная тактика доктора Геббельса взята на вооружение, и потому от хронических заболеваний на Дубровке погибло более 100 заложников, не проживших и 35–40 лет, среди них профессиональные военные, спорсмены, и… дети, дети,. еще не успевшие в своей короткой жизне «накопить» хронические болячки и познакомиться с врачами. Мародерство, это -дно, и, как выясняется, оно поощрается государством, иначе никто бы не осмелился судиться, да еще требовать бумажки о законности- ведь на судопроизводство по этому дело тратится гораздо большие суммы, чем те, о которых идет речь … Это- грязное шоу, чтобы отвлечь от главного- почему погибли наши родные.И все же очень хотелось бы узнать имена и фамилии, место работы этих нелюдей. которым нужны характеристики и справки о честности тех, кого они вероломно убили.Страна должна знать своих…

Нет, конечно, за эти почти семь лет, наобщавшись вволю с чиновниками и следователями всех мастей, наверное уже мало чему удивлюсь… Но тут просто зло взяло, да сколько же можно над нами издеваться! Честное слово, если бы « мы все разом взлетели», то наверное государству было бы легче: нет свиделей и преступников, а с родственниками погибших общаться, наверное, легче — им было бы не до того…Это какой-то непрекращающийся « маразм», начиная с того момента, когда люди в масках вошли в зал и до сегодняшнего дня. Все ждем, что еще, какие оправдания собственному беззаконию, непрофессионализму, коррупции и просто хамству придумают те, кто поставлен нас защищать и нам помогать! А если завтра это случится с вашей семьей, если именно вы столкнетесь с равнодушием и нежеланием помочь? Все под Богом ходим, всем все вернется, уж поверьте!
