The Investigative Committee of the Russian Prosecutor's Office (SKP-RF) for the Moscow district has confirmed that a preliminary investigation into hostage taking at the theatrical center on Dubrovka, which was suspended in 2007, was resumed, but only temporarily and for technical reasons. The investigation was reopened so that «materials relating to theft from victims could be used in a separate proceeding,» the SKP explained. «Materials were provided for separate proceedings, and, as of December 20th of last year, the investigation into the seizure of hostages at the theatrical center was once again suspended,» said a representative of the investigations department. According to the source, since the case had close to a thousand victims, notification of the resumption of the proceedings, as well as their suspension, «is reaching them only now.» Earlier on Wednesday, Igor Trunov, the attorney representing the victims, said that the investigative department of the SKP-RF had resumed the investigation into the case, which had been suspended in 2007. «We received a notification that the investigation was reopened,» he said. According to Trunov, the report explained that the investigation was suspended due to failure to locate G. Dudayev, A. Zakayev, and other persons subject to criminal liability. At the same time the SKP advised that the investigation was reopened because it was necessary to gather data for the other proceedings. «If we are talking about resuming the investigation of the case, then this means that someone was being sought,» said Trunov. «But if the investigation itself was reopened, then that means that they found someone.» He also said that the criminal case under Part 2 Article 158 of the Criminal Code, theft of property that occurred during the investigation into the terrorist attack at the theatrical center on Dubrovka, as well as the hostage taking case, are both under the same investigator. «We can only hope for a fair investigation into the looting case,» said the lawyer, explaining that now the investigator is investigating himself. «Смешно и стыдно»: бывшая заложница «Норд-Оста» об отказе суда возместить моральный вред за хищение денег во время следствия
Жительница Калининграда Алена Михайлова, пострадавшая при теракте на Дубровке в 2002 году, прокомментировала ИА REGNUM решение Замоскворецкого суда Москвы, частично удовлетворившего ее иск о возмещении ущерба в связи с хищением имущества заложников уже во время следствия.
«Смешно и стыдно,— сказала Алена Михайлова.— Намного проще было прокуратуре Москвы не доводить дело до суда, а вернуть ту небольшую сумму, которая была конкретно у моего мужа Максима [генеральный директор „Общественного калининградского радио“ Максим Михайлов погиб во время штурма театрального центра на Дубровке.— ИА REGNUM]». По данным адвоката потерпевших Игоря Трунова, в пользу семьи Михайловых суд постановил взыскать с Министерства финансов 9 тыс. 845 рублей в счет имущества, которое находилось при Максиме, и 10 тысяч рублей в качестве возмещения судебных расходов. Суд также постановил прокуратуре Москвы выплатить штраф в размере 100 (ста) рублей в пользу государства.
То факт, что суд отказал в возмещении морального вреда и процентов за использование чужих денежных средств, по словам Алены Михайловой, «пусть останется на совести тех людей». «Я бы не стала обращаться в суды, если бы мой и еще один иск [пострадавшей Екатерины Долгой, у которой пропало 82 тыс. 720 рублей, находившихся при ней во время теракта.— ИА REGNUM] не стал своеобразным бульдозером, за которым последуют аналогичные иски других заложников»,— продолжила собеседник ИА REGNUM. По ее словам, «наши иски были самые легко доказуемые, поскольку деньги были описаны и пропали уже во время следствия».
Теперь, по мнению Михайловой, прецедент создан, и она ожидает наплыва исков. «На момент, когда в октябре 2008 года мы подавали иск, уже было известно о сорока бывших заложниках, у которых пропали десятки тысяч долларов, а также драгоценности», уточнила она. Жительница Калининграда отметила, что проблема гораздо шире: «Точно такие же иски по мародерству уже во время следствия есть по взорванному дому на улице Гурьянова в Москве, по взрывам в метро и самолетов». «Это большая тема, которой до этого никто не занимался»,— резюмировала Алена Михайлова.
